When I saw the verdict form in this case over the weekend I couldn't help but think of one of my favorite Bill Mauldin cartoons. Mauldin, as those interested in WW II history will recall, was the cartoonist who was much beloved for his series of GIs Joe and Willie in the military newspaper Stars and Stripes. In one of the most popular, a German tank parks over their foxhole and Joe rings up his artillery and says "Able Fox Five to Able Fox. I got a target but ya gotta be patient.”
A Marshall jury in Judge Rodney Gilstrap's court rendered a verdict - sort of - Friday afternoon in SimpleAir v. Google. The jury found that Google infringed all five asserted claims, and that the claims were not invalid.
The jury then left the damages question blank.
