As readers may recall, a Tyler jury in Judge Davis' court found willful infringement and assessed $23 million in damages in this case last spring. This afternoon Judge Davis ruled on the assorted pretrial motions.
Judge Davis denied the defendant's JMOL as to infringement, invalidity, willfulness (analyzing the issue under Bard I would note) and damages, its request for findings of indefiniteness, and its motion for new trial. He granted in part Fractus' motion for enhanced damages (adding $15 million), denied the request for an injunction, severed Fractus' request for ongoing royalties into a separate action, and granted Fractus' motion for prejudgment interest and costs.
The order is 85 pages, and begins with something I've never seen before in a local order - a two and a third page single spaced table of contents. I have not studied it yet, but I'm pretty sure you could practice an awful lot of patent law just cribbing from this order...
