Last month Judge Gilstrap cranked out his first Markman ruling, a 36-page tome, only 19 days after the hearing, which was held two days after he was robed and three days before Christmas. Back in January we thought that was pretty quick.
But today Marshall's new magistrate judge Roy Payne working downstairs from Judge Gilstrap (on the first day his law clerk reported for work, I must note) issued his first Markman ruling (actually a provisional ruling in line with recent practice from other judges in Tyler) as to nineteen claim terms 51 hours after concluding the hearing Monday morning. And here I thought the news that Judge Gilstrap has entered amended docket control orders in several patent cases set for trial in 2014 moving the trial settings up a year would be the news of the week.
