Texas Lawyer's John Council has a good edition of his "Reversed and Remanded" video blog this week in which he talks with Sidley & Austin's Steve Malin about the In re TS Tech case, as well as John's article on the federal judge "slowpoke" report (which bears the subtitle of the classic country song "I Stayed Your Case and You Called Me a Slowpoke, You Darn Patent Lawyer, You"). The article appears here and is a good explanation of the risks associated with unprotected stays - for example the reopening of the DataTreasury cases following a stay pending reexam is what pushed Judge Folsom into double digits for cases pending over three years.
