Copyright Infringement and Unfair Competition Case With "Hollywood Stars" Set for Trial in Marshall
Thanks to both sides' jury consultants and assorted staff and assistants it's all over town that a trial with honest to goodness "Hollywood stars" (which they say in low whispers) is set to occur in Marshall later this month. (Like we're not used to that - Denzel Washington premiered his Great Debaters movie in Marshall last year since it was based on the debate team from local Wiley College). Anyway, yeah, yeah, Hollywood stars, big whoop. We know Denzel, and you're no Denzel.
West v. Perry, et al., 2:07-cv-200 is a copyright infringement and unfair competition trial scheduled to begin December 2, 2008 in Marshall. Donna West filed suit against Tyler Perry, individually and d/b/a
Tyler Perry Company, Tyler Perry Company, Inc. and Lions Gate
Entertainment, Inc., alleging copyright infringement and unfair competition
arising under the Copyright Act, 17 USC §101 et seq., and under
the state and common laws of Texas. West claims that Defendants’ 2005
film titled “Diary of a Mad Black Woman” was copied largely from her
original script entitled “Fantasy of a Black Woman” which she performed
in a play in Dallas in 1991.
So why am I running a photo of the new starship Enterprise from the forthcoming Star Trek movie, which is a reboot of the 1960's series complete with new Kirk and Spock? (Words cannot express how highly I recommend watching the new trailer, by the way
- there's a good Corvette chase scene. No, seriously. And if you've ever wondered what the Enterprise looked like under construction - see to the right). Because Mr. Perry plays a minor role as some sort of Starfleet judicial officer in the new movie. See? I didn't even have to invoke Kevin Bacon to link the two.
