"Effect of eBay v. MercExchange on District Courts' Decisions Whether to Grant Injunctions in Patent Cases" - article

44thipcThe other thing I forgot to post on is the paper I did for the Center for American and International Law in Plano, Texas' 44th Annual Conference on Intellectual Property Law on the effect of eBay on district courts' decisions whether to grant injunctions last month.  The paper is attached here - Download effect_of_ebay_paper.pdf
Since I left on my vacation the day before the seminar, I recruited a real patent lawyer, Mark Reiter from Jones Day (who looks more or less like the picture below, although it depends on the stage of the litigation) - to present the paperReiter for me.  Mark even agrees with parts of it.

Good work on this eBay paper. It was very helpful to see read about all these follow on cases in one place. Do you think plaintiffs will be discouraged from filing thier patent case in E.D. Texas, thinking it will be harder to get a permanent injunction upon victory? Keep up the good work.
