COMMENTS:
This is a patent case in which the plaintiff sought to compel production of worldwide financial information. Judge Love denied the motion, holding that the plaintiff's PICs under P.R. 3-1 did not provide the type of "particularized accusations" that would have put the defendant on notice that the plaintiff was asserting claims under 35 U.S.C. Section 271(f). He ordered the plaintiff to first file a motion for leave to amend its PICs to add 271(f), which would require it to show "good cause" for the amendment under P.R. 3-7.
