Defendants' Motion for Partial Summary Judgment of Non-infringement Granted in Part

CUMMINS-ALLISON CORP. v. 1. GLORY LTD., 2005 U.S. Dist. LEXIS 38857 (E.D. Tex. 2005)
Judge: T. John Ward
Division: Marshall
Holding: Defendants' Motion for Partial Summary Judgment of Non-infringement Granted in Part
COMMENTS:
This is a patent case involving "currency discriminators" which are basically the machines that banks use to count cash.  Following the Markman ruling, Judge Ward issued this order on the defendants' motion for partial summary judgment of noninfringement.  Judge Ward granted the motion in part, finding that certain claims were not infringed, but denied it as to others, finding that fact issues precluded a finding of noninfringement with respect to certain of the claims asserted in the case.
