This is a Fair Credit Reporting Act (FCRA) case, (15 U.S.C.S. § 1681) alleging that defendants reported inaccurate information on the plaintiff's credit reports and failed to correct the inaccuracies. One of the agencies filed a partial motion to dismiss the claims for injunctive relief as barred under the FCRA. Judge Davis held that private litigants could not seek injunctive relief against consumer reporting agencies under the FCRA, and to the extent injunctive relief was sought under state law, the FCRA preempted it.
