Holding: Defendants' Motion to Transfer Venue DENIED
Plaintiff sued a local telephone exchange carrier, claiming that it violated the Sherman Act when providing access to its facilities. Judge Folsom denied the defendant's motion to transfer venue from Texarkana to San Antonio, holding that the Plaintiff's choice of forum is highly esteemed, and that the Defendant had failed to tip the balance in its favor on any of the private interest factors, or show that the balance of the public interest factors favored a transfer. In addition, the Court held that the telecommunication services at issue in this lawsuit "swim in a stream of commerce flowing through the Eastern District of Texas" and that there was accordingly a strong local interest in the resolution of the case.
